These Terms & Conditions (“Terms”) govern your use of fernrain.com and any purchases made through it. By shopping with us or browsing our site, you agree to these Terms and the policies they refer to.
1. Eligibility and use of the website
By using this website, you confirm that you are at least 18 years old or have the legal capacity to enter a binding contract. Our products are for personal, non-commercial use. Misuse of the site or products may result in refusal of service.
2. Orders and acceptance
- All orders are subject to acceptance by Fernrain. An order is accepted only when we send an order confirmation email.
- We may cancel or limit orders at our discretion, including for pricing or listing errors, stock limits, or suspected fraud or misuse. If we cancel an order after payment, we issue a full refund.
3. Pricing, taxes and payment
- Prices are in US dollars. Applicable sales tax is added at checkout.
- Prices may change at any time without notice. In the event of a pricing error, we may cancel the order and refund it.
- Refill plan price changes follow our Refill Plan Terms.
4. Refill plans
A refill plan is a recurring purchase that renews until you cancel. Our Refill Plan Terms form part of these Terms.
5. Shipping and delivery
Shipping timelines and delivery responsibilities are set out in our Shipping Policy, which forms part of these Terms. Risk of loss passes to you on the carrier’s delivery confirmation to the address given at checkout.
6. Returns, refunds and replacements
Returns, refunds, replacements and the 60-day guarantee are governed by our Returns & 60-Day Guarantee, which forms part of these Terms.
7. Intended use and product responsibility
- Use products only for their intended purpose and as the instructions in the box describe, on a standard ½″ US shower connection.
- Replace the filter stick every 10 days.
- Fernrain is a shower filter. It is not a medical device and does not make water safe to drink.
- We are not responsible for damage, leaks, injury or loss caused by misuse, modification, incorrect installation, failure to follow instructions or use beyond the intended purpose.
8. Warranties and disclaimers
To the fullest extent permitted by law, and apart from our 60-day guarantee, products are provided “as is” and “as available”, and we make no implied warranties beyond those required by law.
9. Limitation of liability
To the maximum extent permitted by law, our total liability is limited to the amount paid for the product, and we are not liable for indirect, incidental, consequential or special damages, including loss of profits, loss of use, loss of data or third-party claims.
10. Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, pandemics, labor disruptions, transport interruptions, regulatory action or carrier delays.
11. Intellectual property
All content on this website, including text, images, videos, designs, graphics, logos and our water data, is the property of Fernrain or used with permission, and may not be copied, reproduced or used without prior written permission.
12. Reviews and photos you send
When you send a review or photo, you confirm it’s your own and honest, and you allow us to show it on our site and in our marketing. We may decline or remove reviews that are off-topic, offensive or not about a real purchase.
13. Prohibited activities
You agree not to misuse the website, attempt unauthorized access, scrape or copy content or data, interfere with how the site works, or engage in fraudulent or abusive behavior. We may restrict access or refuse service if these Terms are broken.
14. Governing law and jurisdiction
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. Disputes will be resolved exclusively in the state or federal courts located in Wyoming.
15. Electronic communications
By using our website or contacting us electronically, you agree to receive communications from us electronically. These satisfy any legal requirement for written notice.
16. General
- We may assign or transfer these Terms without consent, including in a merger, acquisition or sale of assets.
- If any provision is found invalid or unenforceable, the rest remain in full force.
- Failing to enforce a provision is not a waiver of it.
- We may update these Terms. Changes take effect when posted; continued use of the website means you accept them.
